Cubu considers respect for the privacy of the personal data held as the person responsible for its processing to be of the utmost importance. Protecting the privacy and personal data of its customers and any and all holders of personal data is one of the commitments of its Management Bodies. Whenever any processing of personal data of customers or other natural persons occurs, namely for the execution of the company’s activities, such personal data will be processed in accordance with this Privacy Policy and the applicable legislation on the protection of personal data.

The person in charge of data protection is the person appointed by the company whose main responsibility is to ensure compliance of data processing with current legislation, verifying compliance with this Data Protection Policy, ensuring that everyone who entrusts it the processing of their personal data, be aware of how the company treats them and what rights they have in this matter. He cooperates and is a point of contact with the supervisory authority on matters of processing personal data. Therefore, holders of personal data, if they wish, may send a communication to the Data Protection Officer, regarding matters related to the processing of personal data, using, for this purpose, the following contact:

“Personal data” means any information relating to an identified or identifiable natural person (“data subject”), namely name, identification (NIF-tax identification number, Citizen Card/Identity Card, Passport, Letter Driving License, IBAN…), email address, address, title, date of birth, gender or profession, or other specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. Only Cubu has access to the personal data collected. The sharing of data with third parties or with Cubu’s partner companies, or with administrative or supervisory entities, may only occur within the scope and for the purposes of executing the existing contract with the respective company, restricting sharing to necessary data and sufficient for the execution of the contractual obligation or the legal requirement that determined it. Cubu requires that its service providers comply with the adopted privacy policy, being held responsible for infringements thereof. The use of personal data for purposes other than those of the existing contractual relationship is subject to the prior consent of the holders. All personal data collected by the company is stored on servers and databases in which various security measures have been implemented, and can only be accessed by employees specifically authorized for this purpose. Each data controller and, where appropriate, its representative keeps a record of all processing activities under its responsibility.

The period of time for which personal data is stored and preserved varies according to the purpose for which the information is processed. The personal data collected will be stored for the duration of the data subject’s contractual relationship with the company and/or for the periods necessary to fulfill the purposes of its collection, being deleted as soon as this need ceases or the legal period for its conservation has passed. and this is requested by the data subject. The processing of personal data for the purpose of sending communications regarding products, services or other information will cease as soon as the holder withdraws their consent for this purpose.

Holders of personal data are guaranteed the right to access, rectify, update, limit and delete their personal data (except when the data is essential for contractual execution), the right to oppose the use of the same for commercial purposes and the withdrawal of consent, without this compromising the lawfulness of the processing carried out under that consent, as well as the right to data portability. Holders of personal data may contact those responsible for processing their data to exercise their rights in relation to the personal data they provide, using the contact details referred to in point 1.

Our commitment is that personal data collected, stored and processed by Cubu is always protected by appropriate security measures, namely by authentication/access control system (login and password), pseudonymization or encryption (SSL) of personal data used in the transaction processing and other appropriate physical, electronic and procedural procedures. We ensure the confidentiality, integrity, availability and permanent resilience of data processing systems and services and adopt measures to restore availability and access to personal data in a timely manner in the event of a physical or technical incident.

Cubu reserves the right to interrupt or suspend access to its website, for as long as it deems necessary, for any technical, administrative, force majeure or other reasons. Without prejudice to the provisions of the previous paragraph, Cubu cannot be held responsible for any suspension or interruption of access that may occur for reasons that are not attributable to it or that are attributable to mere negligence.

Users of the website declare and guarantee that they are fully aware of the characteristics and constraints, limitations and defects of the Internet, and in particular that data and information transmissions via the Internet only benefit from relative technical reliability, circulating in heterogeneous networks with different technical characteristics and capabilities, which disrupt access or make it impossible at certain times. Users acknowledge that any website/portal is subject to intrusion by unauthorized third parties and may consequently be interrupted, and that information circulating on the Internet is not protected against possible deviations (free access), against possible viruses, and that any person is likely to create a link with access to the website/portal and/or elements contained therein, accepting the inherent risks. Cubu cannot under any circumstances be held responsible for accidental or voluntary damages suffered by Users whether or not caused by third parties in the context of the use of services provided on the websites or in other places on the Internet to which they have had access through it.

Cubu is not responsible for any damages that may be caused by the use of the service, including virus contamination.

Without prejudice to the confidentiality commitment (which must be an obligation of means) regarding the use of personal data, Cubu warns that there are risks related to the use of the Internet, and it is possible that personal data contained in the portal may be captured and /or transferred by third parties, without any liability on the part of Cubu.

The Privacy Policy may be modified at any time by CUBUf, without the need for prior notice.
